Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all salaries earned (INFO # 3) at the rate consented to by the employer and worker.

– Pay of at least minimum wage (INFO # 1), the relevant Colorado or employment regional minimum wage, and all made overtime wages without impermissible reductions from their incomes;.

– Pay of all made earnings without impermissible deductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS enforces a lot of Colorado’s wage and hour and other types of labor statutes and labor rules, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules websites for current and previous versions of essential Colorado labor statutes and rules.

Written Demands, Complaints, & Investigations

Demands & Complaints for employment Wages: If an employer owes you salaries, you can send your company a written need for payment of salaries by mail, email, employment text message, or other electronic methods. A written need might be sent to the company at the exact same time a Labor Standards Complaint Form for overdue salaries is filed with the Division. Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and examined, a letter discussing the nature of the grievance and the quantities declared to be owed is sent out to the employer. Investigations Launched by the Division (” Direct Investigations”): The Division may perform employer-wide direct investigations of prospective infractions of Colorado wage and hour law. If you wish to file a private claim for unpaid earnings, you should complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct examination citation or one or more Notices of Assessment, a supposed employer might send a Direct Investigation Appeal Form.
